This is according to general competition rules and Rally regulations.
The Rally, which will take place from July 3 to July 12, 2010 (the Event), will also be held according to each visited province’s highway codes.
The Organizing Committee maintains the right to modify the present regulations according to needs and pertinence in which case all participants will be informed appropriately.
French and English will be the official languages; route books and instructions will be bilingual. French will supersede English in case of litigation.
The Event will be known as the 2010 NAPA RALLY 5000 (The “Rally”) and presented by NAPA Auto Parts a Division of UAP inc. (NAPA AP).
The Organizing Committee is composed of different individuals specialized in promotional events, car rallies and NAPA Canada corporate executives. One may reach the committee by email at info@naparally5000.ca.
The 2010 NAPA Rally 5000 is strictly an abilities sporting event combining three scoring elements: NAPA Challenge, NAPA Rally and NAPA Bonus.
A navigational rally is not a race! It is a challenge requiring precision in both driving and navigation. The goal is to stay on the course set forth in the route instructions provided by the rally organizers, and at the legal speed limit.
The objective is to be at the right place at the correct time. Checkpoints are dispersed along the route and their locations are not divulged to competitors. If competitors follow instructions correctly, they will encounter these checkpoints in the correct order and at the correct time. However, competitors can make driving or navigational mistakes and arrive too early or too late or even miss a checkpoint, thus accumulating penalties. The winning team will be the one that followed the route and the time defined in the instructions with the most precision.
Daily points will be awarded according to the Point System Grid in Section 12.
At no time during the course will participants be requested to drive at speeds superior to 5% of the posted road limits.
Any performance challenge containing an element of speed will be done in a controlled environment with a single vehicle at a time on the course.
All vehicles must be operated in conformity with all local, provincial and national laws and by-laws. It is the responsibility of each participant to conform to all applicable requirements to operate a motorized vehicle in Canada, including a valid driver’s license.
The Event headquarters will be located in Montréal, Quebec for the duration of the Event. The award ceremony will also be held there.
A preliminary meeting and technical inspection will be held for drivers AND co-drivers in the region of the start to answer last minute questions on rules and other items, including the instructions in the route book.
The official start of the 2010 NAPA Rally 5000 will be held at a venue to be determined by the Organizing Committee.
The Event will last for 10 days in Canada and the exact itinerary will be communicated to the teams prior to the start of the event.
The Event headquarters will be located in Montréal, Quebec for the duration of the Event. The award ceremony will also be held there.

The Event will take place in Canada over 10 days. The exact itinerary will be communicated to participants shortly.
Schedule and timetable are subject to change, but all participants will be informed on the Official Board prior to the start of a leg or individually after the start of a leg.
Friday, July 2 : Participants’ arrival for the start of activities
Saturday, July 3 : Training Day and Start of Event
Monday, July 12 : Finish in the Greater Montréal area
The itinerary of the 2010 NAPA Rally 5000 is prepared for amateur crews of two persons to be determined in part by a selection of the Organizing Committee and a popular vote as described in paragraph 8.6. Instructions will be simple, including kilometres and times to respect. In addition, there will be ability challenges as part of the Event.
At certain times, answers to questions will need to be found and written in the route book and handed to the official in charge of the Rally.
The Organizing Committee reserves the right to change the format of the Event, in which case all participants will be informed.
Certain areas of the course will be identified as quiet zones. Teams will have to comply with low posted speeds. Any infringement of a traffic regulation will be addressed by the Organizing Committee and is liable to receive a penalty up to exclusion.
Total distance of the 2010 NAPA Rally 5000 will be approximately 3,000 Kilometres on paved roads and the rest will be gravel or dirt.
Special tests requiring driving skills will be staged on closed course and only one car at the time will be allowed.
Event will be held only in Canada and all necessary instructions and maps will be supplied by the Organizing Committee.
There will be no counter rally traffic unless otherwise specified and on large highways only.
No roads will be closed to normal traffic, except during special challenges.
All members of the Organizing Committee will be considered judges of fact.
Employees, agents and representatives of the Organizing Committee members, of any company, corporation, trust or other legal entity controlled by or related to them, of NAPA Auto Parts points of sales (the “Points of Sale”), their advertising and promotion agencies, suppliers of prizes, material and services related to this Rally, as well as members of their immediate family (brothers, sisters, children, father, mother), their legal or common-law spouse and any person with whom such persons are domiciled, are excluded.
To be selected, eligible persons who wish to apply to be candidates to participate in the Rally (the “Candidates”) shall, in addition to complying with all conditions provided in these rules:
Reside in Canada;
Be aged 21 years old or older;
Be available between July 2, 2010 and July 13, 2010;
Have a valid license between May 2, 2010 and July 13, 2010 and have a driving record without any major offence (e.g. drinking and driving, important speeding...). A copy of the driving record of each finalist and entrant shall be required.
Candidates may register individually or as a team (driver and co-driver) during the Entry Period. The selection committee, constituted of the members of the Organizing Committee (the “Selection Committee”), may however, at its sole discretion, form the teams itself. The Selection Committee will nonetheless try as much as possible to maintain together a team composed of two persons who have registered together. Limit of one entry per Candidate and per team during the Entry Period.
Candidates must register on www.naparally5000.ca (the “Website”) from April 8, 2010 at 9:00 am (EDT) until May 9, 2010 at 11:59 pm (EDT) (the “Entry Period”). On the homepage, the Candidate must follow the instructions to access the entry form (the “Entry Form”) which must be filled out in conformity with the instructions detailed below. Candidates will also have to confirm that they have read and agreed to the eligibility requirements, the entry conditions and the Rally rules. In the case where a Candidate registers a team member, such team member shall also have to visit the Website to fill out the Entry Form in the same manner as the Candidate who registered him or her. It is important to note the three candidate-selection criteria set out at section 8.6 of these rules.
Step 1: Your contact information
Steps 2, 3 and 4 (your navigation skills, your mechanical skills and your motivation). It is mandatory that you answer all questions set out at each of these three steps;
Step 5: Forming your team. Complete this step if you wish to register a team member by indicating his or her first and last name, e-mail address and declare that you confirm that this person consents to being contacted by the Organizing Committee, solely for the purposes of the Rally, by checking the appropriate box.

If you have invited a friend whose entry is uncertain, you have the opportunity to invite a second friend by following the instructions to this effect from the entry confirmation page or from the e-mail confirming your entry. The first person to complete the Entry Form shall be considered as the official team member of your team.
E-mail confirming your entry. An e-mail confirming your entry will be sent to you. You can submit a video (optional) by following the instructions to this effect from your confirmation e-mail, including certifying that you have read and agreed to the Statement of consent, authorization and release in connection with the photograph and video at the latest on May 9, 2010 at 11:59 pm (EDT).

Selection of the teams which will take part in the Rally will be done as follows:
Step 1 - Entry period from April 8, 2010 at 9:00 am (EDT) until May 9, 2010 at 11:59 p.m. (EDT) (the “Entry Period”). Terms and conditions regarding registration are detailed at section 8.4 of these rules;
Step 2 - Between May 10, 2010 and May 28, 2010, the Selection Committee will select eight Candidates (4 teams) in each one of the following five regions: British Columbia, Prairies, Ontario, Quebec and Atlantic provinces (the “Regions”). Once selected, all Candidates shall have to provide a copy of their driving license and driving record to the Organizing Committee. In addition, they shall mandatorily have to take part in an interview through Skype (the “Interview”). Following the Interview, the Selection Committee will select, in each Region, two finalist teams (the “Finalist Teams”) which will be presented to the public for a popular vote and, in an order at its sole discretion, two replacement teams (the “Replacement Teams”);
Step 3 - Voting Period. Between May 31, 2010 at 9:00 am (EDT) and June 13, 2010 at 11:59 pm (EDT) (the “Voting Period”), the public, as well as the drivers and co-drivers of the Finalist and Replacement Teams, will be able to vote on the Website for their favourite team in each Region among the two Finalist Teams for each Region. Each person may vote only once in each of the Regions;
Step 4 - The Selection Committee (50%) and the popular vote (50%) will determine which team of each one of the Regions will participate in the Rally and will be presented on the Website starting June 14, 2010.
Selection criteria. The three selection criteria to determine which teams shall take part in the Rally are detailed below. The two first criteria shall be evaluated by the Selection Committee and shall count towards 50% of the final decision. The popular vote shall count towards 50%. Any decision taken by the Selection Committee is final and without appeal. The weight given by the Selection Committee to each criterion shall be equal (25% each). The criteria are:
The answers provided to questions at steps 1, 2, 3 and 4 on the Entry Form (25% of the final decision);
Interview through Skype (25% of final decision);
Public vote (50% of final decision).
To be eligible for the Rally, each Candidate shall have to provide the following authorization by checking the appropriate box:
Statement of consent, authorization and release in connection with the photograph and video
I grant NAPA Auto Parts (a Division of UAP inc.) (NAPA AP), and its representatives the authorization to reproduce, broadcast, publish, distribute, represent in public, edit and modify the video and photograph I submitted when I entered the Rally, as well as any other video I may film or picture I may take, or which may be filmed or taken (collectively: the “Material”). I also declare to have obtained and will obtain such authorizations from persons who may be represented in the Material and the authorization of their parents or legal guardians, as the case may be. These are worldwide authorizations, without any compensation and for an unlimited period of time, for the purposes of this Rally or for any other purpose related to the activities of (NAPA AP), including but without being limited to, broadcast in various media, including the Internet and Rally Website. I agree for my first name, last name and place of residence to be used in connection with the Material. I declare that the Material I will submit is original, that I am its sole author or that I have obtained all required rights or authorizations for its use according to the terms set out in these rules and that I am not in violation of any law or third-party right. Upon request, I accept to provide NAPA (AP) and its representatives with the authorizations mentioned in this section. I acknowledge that NAPA (AP) and its representatives have no responsibility concerning the use and broadcast of the Material that I have submitted and that I may submit and that they cannot be held liable for any violation whatsoever under these terms and conditions or terms of use of the Website by users.
The Commitment Period for drivers and co-drivers of teams selected to do the Rally begins July 3, 2010 and ends July 12, 2010 (the “Commitment Period”). During this period, teams must make themselves available to the Organizing Committee at all times.
Replacement Teams will be kept on a waiting list and will be automatically registered as entrants in the Support Crew Contest.
The Organizing Committee reserves its right to accept or refuse any Candidate. Its decision cannot be appealed and need not to be justified. Any Candidate selected to be part of a Finalist or Replacement Team shall have to be reached by the Organizing Committee at the latest on May 28, 2010 otherwise he or she shall be disqualified and the Organizing Committee shall be entitled to select a team member from a Replacement Team to replace him or her.
Upon receipt of a Candidate’s commitment, a confirmation (or negative reply) for an invitation for an Interview will be sent.
There is no entry fee for the 2010 NAPA Rally 5000. However, during the Event, participants will need to cover their own personal expenses (personal products medication, etc).
All selected participants must have read, filled and signed the Event forms mentioned in paragraph 14.0.
Should a participant withdraw from the NAPA Rally 5000, the Organizing Committee will call upon the first reserve candidate in the concerned region to fill in, and this, at the sole discretion of the Organizing Committee.
Should the Organizing Committee determine that the behavior of a participant is unacceptable; the said committee could disqualify the participant and call upon the first reserve candidate in the concerned region to fill in. Such a decision is final and cannot be appealed.
A participation in the NAPA Rally 5000 gives access to:
A maximum early and late time will be permitted to teams at each stage.
Any additional delays will be judged at the sole discretion of the Organizing Committee.
Each team will start the Event with no points. The goal of the NAPA Rally 5000 is to earn as many points as possible throughout the Event (500 points total, plus Facebook action worth a bonus of 125 points for a maximum daily total of 625 points), distributed according to the grid below:

Evaluation criteria and results.
To establish the teams’ daily finishing order and receive the points associated with their rank, the Organizing Committee will distribute points according the criteria described in the following paragraphs.
Points distributed for criteria #1, NAPA Challenge, will count for 60% of the total 500 daily points (300 points maximum for 1st place)
First place will receive 300 points; second place, 270 points; third place, 240 points; fourth place, 210 points; fifth and last place will receive 180 points.
These points will be distributed according to the following criteria:
Points distributed for criteria #2, NAPA Rally, will count for 30% of the total 500 daily points (150 points maximum of 500 for 1st place).
First place will receive 150 points; second place, 135 points; third place, 120 points; fourth place, 105 points; fifth and last place will receive 90 points.
These daily points will be distributed according to the following criteria:
Points distributed for criteria #3, NAPA Bonus, will count for 10% of the total 500 daily points (50 points maximum of 500 for 1st place).
First place will receive 50 points; second place, 45 points; third place, 40 points; fourth place, 35 points; fifth and last place will receive 30 points.
These daily points will be distributed according to the following criteria:
Points will be distributed for FACEBOOK Actions, for a maximum of one hundred twenty-five (125) points per day, per team. To receive these bonus points, each team will have to complete tasks according to directives and criteria given prior to the event.
The winning team will be determined by the general standings and will be the team earning the highest total of points at the end of the Event. The three prizes for the top three finishers are:
1st prize, of a $15,000 value, includes $10,000 in cash and $5,000 in parts and products distributed by NAPA Auto Parts;
2nd prize, of a $4,000 value, includes $3,000 in cash and $1,000 in parts and products distributed by NAPA Auto Parts;
3rd prize, of a $1,000 value, includes $500 in cash and $500 in parts and products distributed by NAPA Auto Parts.
Prizes will be distributed evenly between the two members of the winning teams on August 16, 2010.
The winners will have one year from the prize distribution date to take possession of their prizes.
Winners will have to go to the NAPA Auto Parts store selected by the Organizing Committee to retrieve the totality of their prize in one or more visits.
Winners are responsible for their own transport to collect prizes. If the winners live outside a radius of 350 Kilometres of a NAPA Auto Parts store, delivery charges will be taken care of by the Organizing Committee.
An incentive prize will be given to pilots and co-pilots: an Apple iPad tablet device which value varies between $499 and $899.
The contest is open from 9:00 a.m. (EST) on April 21, 2010 to 11:59 p.m. (EST) on May 9, 2010. Only those who have registered as pilots or co-pilots are eligible to win an iPad. Should an iPad be unavailable, the prize may be replaced by another prize of equivalent or greater value, without notice. The draw will take place in Montreal on May 11, 2010 at 10:00 a.m (EST).
To be eligible to the Rally, Candidates shall have to sign the following forms and return them to the Organizing Committee within the established timeframe:
Fill out the commitment form which shall be sent to them by e-mail by the Contest Organizers or their representatives;
A Statement of consent, authorization and release in connection with the photograph and video, as set out at section 8.7 (the “Authorization Form”);
A Declaration and release form (the “Declaration Form”), to the effect that he or she has complied with all the conditions mentioned in these rules.
All vehicles used in the Event will comply with the Highway Safety Code.
A technical inspection will be done prior to all daily legs. Any violation must be corrected by the participants before the start of the leg. Any violation not addressed or corrected will encounter a lost of points.
All communication devices are strictly prohibited except for those provided by the Organizing Committee. Failure to comply could encounter a loss of points up to exclusion.
All participants must comply with all eligibility criteria mentioned in 8.1 and 8.2.
All participants must show the Organizing Committee the required documents (driver’s license, health insurance number, etc.) before the Event.
Only distances in kilometres will be used with cumulative and non-cumulative measures between instructions.
Instructions will be given with the help of a diagram representing the intersections and direction to follow (tulip diagram). Any available and relevant instructions and/or pictures can be added.
There will be a maximum distance of 400 kilometres between fuel stops. Optional service points could be available. Carrying fuel is strictly prohibited.
No public roads will be closed to normal traffic. All special sections will be accessible by only one car at the time.
The Event Organizers reserve the right to disqualify a person or to void one or more entries at their sole discretion in the occurrence of an event or human interaction causing any alterations or affecting the administration, the safety, the impartiality or the running of the Event as described in the present Event rules.
If two teams complete the Event with the same total of points, priority will be given to the team earning the highest total of points in the mechanical activities (NAPA Challenge). If the tie subsists, priority will be given to the team with the highest total of points in vehicle activities (NAPA Rally). If teams are still even, a tie will be pronounced and prizes shared between all teams concerned.
All vehicles will show numbers, stickers and advertising on their bodywork as supplied by the Organizing Committee.
Any modification to the vehicle’s configuration will encounter a loss of points.
Both members of a team must complete the Event within the allocated time with a vehicle still roadworthy as supplied by the Organizing Committee.
Any situation not covered in the present Regulations should be addressed to the Registrar at info@naparally5000.ca. The Organizing Committee will answer as soon as possible.
Entry and Declaration Forms are subject to verification by the event organizers. Any form which is, as the case may be, incomplete, illegible, reproduced by hand or mechanically, mutilated, fraudulent, obtained from an unauthorized source, registered or transmitted late or otherwise non-compliant may be rejected and will not entitle, as the case may be, to an entry or a prize.
The event organizers reserve the right to disqualify a person or to cancel one or several entries of a person who participates or tries to participate in the event by using methods that do not comply with these rules or that are unfair to other entrants (e.g. entries exceeding the authorized limit).
Any decision by the organizers of the Rally or by their representatives related to this Rally is final and without appeal.
Should a paragraph of these rules be declared or deemed illegal, unenforceable or null and void by a competent court, then such paragraph will be considered null and void. However all other unaffected paragraphs will apply within the limits permitted by law.
Personal information. Personal information regarding all Candidates will only be used for Rally administration purposes, subject to what is set out in these rules. No correspondence, commercial or otherwise, unrelated to the Rally shall be sent to Candidates, unless consent is otherwise provided.
Candidate. For the purpose of these rules, the Candidate is the person whose name appears on the Entry Form and such person shall be identified as the driver or co-driver, as the case may be, if he or she is chosen to be part of one of the teams selected at any of the various steps of the selection process provided in these rules.
Website and event conduct. Any attempt to deliberately damage the Rally Website and/or any related website or to sabotage the conduct of the event constitutes a violation of civil and criminal laws. Should such any such attempts be made, the Organizing Committee reserves its right to disqualify any such Candidate and obtain legal or equitable relief under applicable laws.
Website functioning. The Organizing Committee in no way warrants that the NAPA Rally 5000 Website will be accessible or functional without interruption during the event period or that it will be exempt from error.
Limitation of liability – Rally functioning. The Organizing Committee, any companies, corporations, trusts or other legal entities controlled by or related to it, its advertising and promotion agencies, suppliers of services and merchandise related to the Rally, their employees, agents and representatives disclaim all liability for the malfunction of any computer component, software or communication line, with respect to the loss or absence of a network communication or to any transmission that is faulty, incomplete, incomprehensible or deleted by any computer or any network and which may prevent or limit a person’s ability to participate in the Rally. The above-mentioned persons also disclaim all liability for any damages or losses which may be caused, directly or indirectly, in whole or in part, by the downloading of any Web page, software or other element and by the transmission of any information related to entry in the event.
Communication with Candidates. No communication or correspondence related to the Rally will be exchanged with Candidates, other than provided in these rules or at the Organizing Committee’s initiative. Without limiting the scope of the foregoing, by entering the event, Candidates agree to receive e-mails related to the event. Any notification e-mail sent to a selected Candidate that is followed by a mention to the effect that the message could not be delivered will lead to the Candidate’s disqualification and the selection of a new Candidate.
Limitation of liability – prize use. By entering the Rally, all Candidates release the Organizing Committee, any companies, corporations, trusts or other legal entities controlled by or related to it, their advertising and promotion agencies, their employees, agents and representatives from all liability for damages they may sustain as a result of their participation in the event.
Liability of Prize Providers. Candidates selected for a prize recognize that upon awarding of the prize, the obligation to provide prize-related services and products becomes the sole responsibility of the providers or products and services that make up the prize.
Warranty with respect to the prize. Candidates selected for a prize recognize that the only warranty applicable to the prize is the standard manufacturers’ warranty.
Property. Any forms provided for under these rules are the property of the Organizing Committee and shall in no case be returned to entrants.
Authorization. By entering the Rally, Candidates selected authorize the Organizing Committee and its representatives to use their names, photograph, image, voice, place of residence and/or prize-related statements for promotional purposes, without any form of compensation.
Prize acceptance. Prizes must be accepted as described in these rules and cannot, in whole or in part, be transferred to another person, substituted for another prize or exchanged in whole or in part for cash, except as provided for in the following section.
Prize substitution. Should the Organizing Committee be unable to award a prize (or part of the prize) as described in these rules, it reserves the right to award a prize (or part of a prize) of the same nature and of equivalent value or, at its sole discretion, the monetary value of the prize (or part of the prize) indicated in these rules.
In the event that the computer system fails to register all entries during the period of the Rally, for any reason whatsoever, the selection of teams may be done, at the Organizing Committee’s discretion, among the duly registered entries since the beginning of registration until the date on which registration ended.
“NAPA Rally 5000 Support Crew” is a Contest held by NAPA Auto Parts, a division of UAP Inc. (the “Contest Organizers”). The Contest runs in Canada on the Internet from April 8, 2010 at 9:00 am (EDT) to July 18, 2010 at 11:59 pm (EDT) (the “Contest Period”).
This Contest is related to the NAPA Rally 5000 (the “Rally”). Five Canadian teams shall be selected, one in each of the following regions: British Columbia, Prairies, Ontario, Quebec and Atlantic provinces (the “Regions”). The teams will be announced on June 14, 2010 and will participate in the Rally to be held from July 3, 2010 to July 12, 2010 (the “Rally Period”). For further information on the Rally, visit www.naparally5000.ca.
This Contest is open to all Canadian residents having reached the age of majority in their province or territory of residence at the time of entry. Employees, agents and representatives of the Contest Organizers, companies, corporations, trusts or other legal entities controlled by or related to them, NAPA Auto Parts stores, (the “Points of Sale”), their advertising and promotional agencies, suppliers of prizes, material and services related to this Contest or Rally, as well as their immediate family members (brothers, sisters, children, father, mother), their legal or common-law spouse and any persons with whom such employees, representatives and agents are domiciled, are excluded. To enter the Contest, users must enable “cookies”.

To enter the Contest, you must register on www.naparally5000.ca (the “Website”).
Registration. To register and be eligible for the drawing of prizes, you must proceed as follows:
Website. From the Website home page, follow the instructions provided under the SUPPORT CREW tab to access the Contest and the electronic entry form (the “Entry Form”);
Personal information. Fill out the Entry Form by indicating your last name, first name, e-mail address and phone number, including the area code;
Acceptance. You must declare that you have read and agreed to the Contest Rules;
Send. Click on “SUBMIT” before the end of the Contest Period. You will automatically obtain an entry in the Contest.
Automatic entry. Any person who enters to participate in the NAPA Rally 5000 and is not selected to form part of the five (5) teams is automatically entered into this Contest.
Additional entries. You may obtain additional entries (additional chances to win a prize) in any of the following manners:
Invitation. Earn one additional entry for each friend you invite to enter the Contest or participate in the NAPA Rally 5000. From the Contest entry page, you may indicate up to five (5) friends’ e-mail addresses (5 additional chances to win). Then click on “Submit” to send the e-mail invitation(s) to your friend(s). You will also be provided with this opportunity in the e-mail requesting you to confirm your entry. In any case, you may not obtain more than a total of five (5) additional entries by inviting friends;
Postcard. Earn one (1) additional entry by entering on the Website the three-digit code appearing on the postcard available free of charge at a participating Point of Sale in Canada during the Contest Period, while supplies last;
Vote. From May 31, 2010 at 9:00 am (EDT) until June 13, 2010 at 11:59 pm (EDT) (the “Voting Period”), you may vote for your favourite team among the two finalist teams for each Region by following the instructions provided to this effect. Limits. Entrants must respect the following limits otherwise they may be disqualified:
Contest entries. Only one entry per person during the Contest Period. An entrant who has more than one e-mail address must only use one during the Contest Period;
Invitations. Up to five additional entries per entrant during the Contest Period by inviting friends to participate. Each friend can only be invited once during the Contest Period;
Postcard. One single additional entry per entrant during the Contest Period by using the code on the postcard;
Vote. A maximum of five additional entries during the Voting Period i.e. one vote per Region (5 teams i.e. one per Region);
Webizode and question. A maximum of eight additional entries per entrant during the Contest Period. Regardless of the number of times an entrant screens a given daily Webizode, he or she may only earn a single additional entry for a given daily Webizode if he or she correctly answers the question appearing on-screen at the end of the screening.
The first grand prize offered is products and parts distributed at NAPA Auto Parts valued at $ 10,000. The following conditions apply to the prize:
The choice of products and parts distributed at NAPA Auto Parts shall be at the Contest Organizers’ sole discretion;
The winner shall have one year following the Contest draw date to claim his or her prize;
The winner shall go to a NAPA Auto Parts store selected by the Contest Organizers to pick up the total value of his or her prize in more than a single visit;
The winner is responsible for the fees associated with his or her transportation and the transportation of the products and parts;
Should the winner reside further than 350 kilometres from a Point of Sale, delivery shall be assumed by the Contest Organizers.
Two second grand prizes are offered. Each second grand prize, of an approximate value of $ 2,500, consists of a VIP NASCAR auto race weekend (NAPA Auto Parts 200 presented by Dodge) on August 28 and 29, 2010 in Montreal for the winner and one guest. The prize includes:
Economy round-trip airfare for two (2) persons, from the Canadian international airport located near the winner’s place of residence to Montreal – Pierre Elliott Trudeau International Airport;
Double occupancy accommodations on August 27 and 28, in a standard room at the Sheraton hotel on René-Lévesque Boulevard in Montreal;
Ground transportation between the airport and the hotel in Montreal;
$ 200 in pocket money per person;
One (1) pair of tickets for the NASCAR weekend races (NAPA Auto Parts 200 presented by Dodge).
The following conditions apply to each one of the two VIP NASCAR weekends:
Other than charges and expenses indicated as included in the prize, the winner and his or her guest will be responsible for all charges and expenses, including but not limited to ground transportation between the winner’s residence and the departure (or arrival) airport and between the hotel and race venues, personal insurance, alcoholic and non-alcoholic beverages, meals, taxes, gratuities and excluded activities, Internet access charges, local or long-distance call charges, room service and mini-bar fees, any required hotel deposits, expenses of a personal nature and any required travel-document-related costs, as the case may be.
The winner must travel on the stipulated dates or forfeit his or her prize without compensation;
It is mandatory that arrangements regarding the weekend be made by the winner with representatives of the Contest Organizers. The winner shall have to provide the name appearing on his or her passport or travel ID, as well as the names and contact information of his or her guest. No changes may be brought once the arrangements have been made;
The winner and his or her guest must travel together;
The winner’s guest must be a Canadian resident who has reached the age of majority in his or her province or territory of residence;
Should a portion of the prize not be used, no compensation will be given to the winner or his or her guest;
Seat selection to attend the races is at the discretion of the Contest Organizers;
The approximate value of the prize is based notably on an average value with respect to the portion corresponding to airfare. No compensation in this regard will be given or may be claimed if the value of the prize is less than that indicated in these Contest Rules;
Should the Contest Organizers deem, at their sole direction, that the distance between the winner’s residence and Montreal does not warrant air travel, they may decide not to include the air travel portion of the trip but reimburse the winner for his or her travel expenses. The amount of such reimbursement will be at the sole discretion of the Contest Organizers.
Limit. Limit of one (1) prize per person and per residence during the Contest Period.
On July 19, 2010, at 10:00 am in Montreal at the offices of the agency responsible for administering the Contest, three (3) eligible entries will be randomly selected among all entries registered during the Contest Period to award the prizes in the order in which they are enumerated in these Contest rules.
Odds of winning. The odds that the entry of an entrant be drawn depend on the number of entries registered during the Contest Period.
To be declared a winner, a selected entrant must:
Be reached by phone or by e-mail, at the sole discretion of the Contest Organizers, within seven (7) days of the draw. Should a selected entrant be reached by e-mail, he or she must reply in accordance with the instructions given in the e-mail, as the case may be;
Have correctly answered the mathematical skill-testing question appearing on the Declaration and Release Form (the “Declaration Form”);
Fill out and sign the Declaration Form that the Contest Organizers will provide him or her by mail, fax or e-mail to the effect that he or she has fulfilled all the requirements of these Contest Rules, and return it to the Contest Organizers for them to receive it within seven (7) days of its receipt;
Upon request and in a timely manner, provide an identification card with photograph.
Failure to comply with any of the conditions mentioned in these Contest Rules or to accept his or her prize will cause the selected entrant to be disqualified. In such a case, the Contest Organizers may, at their discretion, cancel the prize or hold a new draw until an entrant is selected and declared a winner.
Within seven (7) days following the receipt of the duly completed and signed Declaration Form, the Contest Organizers will contact the entrants selected for the grand prize or for one of the VIP NASCAR auto race weekends to inform them of how to claim their prize.
Verification.
Entry forms, postcards and Declaration Forms are subject to verification by the Contest Organizers. Any document that is, as the case may be, incomplete, illegible, reproduced manually or mechanically, mutilated, fraudulent, obtained from an unauthorized source, registered or transmitted late, not bearing the correct answer to the mathematical question or otherwise non-compliant may be rejected and will not entitle to an entry or a prize, as the case may be.
Disqualification.
The Contest Organizers reserve the right to disqualify a person or to cancel one or several entries of a person who enters or attempts to enter this Contest by using methods that do not comply with these Contest Rules or that are unfair to the other entrants (e.g. entries exceeding the authorized limit). Such a person may be reported to the appropriate legal authorities.
Conduct of Contest.
Any attempt to deliberately damage the Contest Website and/or any related website or to sabotage the legitimate conduct of the Contest constitutes a violation of civil and criminal laws. Should there be any such attempts, the Contest Organizers reserve the right to disqualify the entrant and to obtain legal or equitable relief under applicable laws.
Prize acceptance.
Prizes must be accepted as described in these Contest Rules and cannot in any case in whole or in part be transferred to another person, substituted for another prize or exchanged in whole or in part for cash, except as provided in the following paragraph.
Prize substitution.
Should the Contest Organizers be unable to award a prize (or part of a prize) as described in these Contest Rules, they reserve the right to award a prize (or part of a prize) of the same nature and of equivalent value or, at their sole discretion, the monetary value of a prize (or part of the prize) indicated in these Contest Rules.
Limitation of liability – prize use.
By entering this Contest, all entrants selected for a prize release the Contest Organizers, companies, corporations, trusts or other legal entities controlled by or related to them, their advertising and promotion agencies, their employees, agents and representatives from all liability for damages which they may incur as a result of accepting or using their prize.
Liability of prize providers.
Any entrant selected for a prize acknowledges that upon awarding of the prize, the obligation to provide prize-related services and products becomes the role responsibility of the providers of products and services which make up the prize.
Warranty with respect to the prize.
Any entrant selected for a prize recognizes that the only warranty applicable to the prize, as the case may be, is the standard manufacturers’ warranty.
Website functioning.
The Contest Organizers in no way warrant that the Contest Website will be accessible or functional without interruption during the Contest Period or that it will be exempt from any error.
Limitation of liability – Contest functioning.
The Contest Organizers, companies, corporations, trusts or other legal entities controlled by or related to them, their advertising and promotion agencies, their employees, agents and representatives disclaim all liability for the malfunction of any computer component, software or communication line, with respect to the loss or absence of network communication or regarding any transmission that is faulty, incomplete, incomprehensible or deleted by any computer or any network and which may prevent or limit a person’s ability to enter the Contest. The above-mentioned persons also disclaim all liability for any damages or losses which may be caused, directly or indirectly, in whole or in part, by the downloading of any Web page, software or other element and by the transmission of any information related to participation in the Contest.
Contest modification.
The Contest Organizers reserve the right, at their sole discretion, to cancel, terminate, modify or suspend this Contest, in whole or in part, should any event or human intervention arise which could alter or affect the administration, security, impartiality or conduct of the Contest, as described in these Contest Rules, subject to the approval by the Régie des alcools, des courses et des jeux du Québec, if required.
Termination of participation in the Contest.
In the event that the computer system fails to register all Contest entries during the Contest Period for any reason whatsoever, or should participation in the Contest end, in whole or in part, before the end date set in these Contest Rules, the draw may be held, at the Contest Organizers’ discretion, among all eligible entries duly registered from the start of the Contest up to the date of the event ending participation in the Contest.
Limitation of prizes.
The Contest Organizers will not be required to award more prizes or to award a prize otherwise than in compliance with these Contest Rules.
Limitation of liability – participation in the Contest.
By entering or attempting to enter this Contest, all persons release the Contest Organizers, all companies, corporations, trusts or other legal entities controlled by or related to them, their advertising and promotion agencies, their employees, agents and representatives from all liability for damages which they may incur as a result of entering or attempting to enter this Contest.
Authorization.
By entering this Contest, any entrants selected for a prize authorize the Contest Organizers and their representatives to use, if required, their full name, photo, image, voice, place of residence and/or prize-related statements for promotional purposes, without any form of compensation.
Communication with participants.
No communication or correspondence related to this Contest shall be exchanged with entrants except as provided for in these Contest Rules or at the Contest Organizers’ initiative.
Personal information.
Entrants’ personal information collected for the purpose of the Contest will only be used to administer the Contest. No commercial or other communications unrelated to the Contest will be sent to entrants unless they have otherwise agreed to receive such communications.
Property.
Entry forms and Declaration Forms are the property of the Contest Organizers and shall not in any case be returned to entrants.
Identification of participants.
For the purposes of these Contest Rules, an entrant is the person whose name appears on the Entry Form and it is to this person that the prize will be awarded if he or she is selected and declared a winner.
Decisions of the Contest Organizers.
Any decision by the Contest Organizers or their representatives regarding this Contest is final and without appeal, subject to a ruling by the Régie des alcools, des courses et des jeux du Québec on any issue under its jurisdiction. All Rally-related decisions made by the Contest Organizers or their representatives are final and without appeal.
Litigation.
For Quebec residents, any litigation respecting the conduct or organization of a publicity contest may be submitted to the Régie des alcools, des courses et des jeux for a ruling. Any litigation respecting the awarding of a prize may be submitted to the Régie solely for the purpose of helping the parties reach a settlement.
Severability of paragraphs.
If a section of the Contest Rules is declared or deemed illegal, unenforceable or invalid by a competent court, that section shall be considered invalid, but all unaffected sections will be applied within the limits of the law.
Language.
Should a discrepancy between the French version and the English version of these Contest Rules arise, the French version will prevail.
